Privacy Policy

How MarkQ Homes Pty Ltd collects, uses, stores and discloses personal information in connection with the Agent MQ platform, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

1. About this policy

1.1 MarkQ Homes Pty Ltd operates Agent MQ, a partner portal for real-estate professionals. This policy explains how we handle personal information collected through Agent MQ, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1.2 It covers personal information about: (a) partner agents who use Agent MQ; and (b) clients and prospective buyers whose details agents register in Agent MQ.

2. What personal information we collect

2.1 From partner agents: name, agency, role, licence or registration details, email, phone number, and login and usage data.

2.2 About clients (registered by agents): name and contact details, and information relevant to a house-and-land purchase such as budget, finance status, property and location preferences, and enquiry history.

2.3 We try not to collect sensitive information (such as health information). Agents must not enter it unless it is necessary and the individual has consented.

3. How we collect personal information

3.1 Directly from agents, when they register for and use the Platform.

3.2 About clients — usually from the agent who registers them, rather than from the client directly.

3.3 Automatically — log data and device and usage information, including through cookies and similar technologies on our website.

4. Information about clients collected from agents

4.1 Where an agent enters a client's personal information, we collect it from the agent rather than from the client. Under our Terms of Use, agents must have told the client that their information will be shared with MarkQ, and must have obtained the client's consent.

4.2 We take reasonable steps to make sure clients are aware of this policy and of how to contact us — including by sending clients a notice when MarkQ first contacts them and by making this policy available at https://agent.markq.com.au/legal/privacy.

5. Why we collect, hold, use and disclose personal information

5.1 We use personal information to: operate Agent MQ; register and respond to client enquiries; match clients to suitable Packages; progress a sale and the building process; provide customer service; carry out administration, security and analytics; and meet our legal obligations.

6. Who we disclose personal information to

6.1 We may disclose personal information to: our related entities and franchisees; the relevant land owner or developer for a house-and-land package; our service providers (such as IT hosting, CRM and communications providers); with the individual's consent, finance or mortgage brokers and similar third parties; our professional advisers and insurers; and any person where we are required or authorised by law.

6.2 We do not sell personal information.

7. Direct marketing

7.1 We may contact clients about Packages where they have consented to receive that contact.

7.2 Every marketing message will identify us and include a functional way to unsubscribe, consistent with the Spam Act 2003 (Cth).

7.3 Individuals can opt out of marketing at any time via the unsubscribe link or by contacting us.

8. Overseas disclosure

8.1 Agent MQ is hosted on servers located in Malaysia. File attachments are stored in Australia (Amazon Web Services, Sydney region). Personal information may also be handled by our service providers, including our email delivery provider, whose infrastructure may be located outside Australia.

8.2 Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles.

9. How we keep information secure

9.1 We take reasonable technical and organisational steps to protect personal information, including encryption in transit, access controls, role-based permissions, and activity logging.

9.2 No system is completely secure. Agents must protect their login credentials and comply with the security obligations in the Terms of Use.

10. Data breaches

10.1 We maintain a data breach response plan. If an eligible data breach occurs, we will assess it and, where required, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) under the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth).

11. Automated decision-making

11.1 Agent MQ does not use automated decision-making that produces legal or similarly significant effects on individuals.

12. Accessing and correcting your information

12.1 You may request access to, or correction of, the personal information we hold about you by contacting our Privacy Officer.

12.2 We will respond within a reasonable time. If we refuse access or correction, we will give you reasons.

12.3 Where an agent has registered a client, the client may also contact us directly about their information.

13. How long we keep information

13.1 We keep personal information only for as long as needed for the purposes described in this policy, or as required by law, and then destroy or de-identify it.

14. Complaints

14.1 If you have a privacy complaint, contact our Privacy Officer at admin@markq.com.au. We will acknowledge and investigate it.

14.2 If you are not satisfied with our response, you may complain to the OAIC at oaic.gov.au or on 1300 363 992.

14.3 Individuals may also have other rights, including under the statutory tort for serious invasions of privacy that commenced on 10 June 2025.
